Labor Law - Professor Keith Cunningham-Parmeter

- Description: This course surveys the legal relationship between employees, unions, and employers in modern workplace settings. Topics include: employee solicitation, employer speech, union recognition, the duty to bargain collectively, strikes, picketing, boycotts, and rules related to public-sector unions. After studying historical trends in unionization movements, the course evaluates emerging organizing efforts in the retail and service sectors. The course also explains the significant impact that labor law has on non-unionized workplaces. To that end, the course examines the relationship between labor law and workplace rules that govern social media posts, business disparagement, and discussions about coworker compensation. By the end of the course you should be able to advise clients on their labor-related rights in both unionized and non-unionized workplaces.

The American Bar Association accreditation standards require students to regularly attend the courses in which they are registered. Lewis & Clark expects students to attend classes regularly and to prepare for classes conscientiously. Specific attendance requirements may vary from course to course. Any attendance guidelines for a given class must be provided to students in a syllabus or other written document at the start of the semester. Sanctions (e.g., required withdrawal from the course, grade adjustment, and/or a failing grade) will be imposed for poor attendance.
