Description:
The class will focus upon the unique characteristics of contracts used in the various categories of entertainment. The objective of all entertainment is to expand its audience and to maintain the maximum number of opportunities for future exploitation of the creative content. The class will explore:
- The types and forms of entertainment agreements;
- Norms established by entertainment custom and practice;
- The impact of collective bargaining agreements by unions and guilds;
- Contract limitations imposed by limits on enforceability by state statutes;

- Minimum annual compensation;
- Restrictions on enforcement of personal service agreements;
- Negative covenants and injunctions;
- Judicial approval of minors’ agreements;
- Distinguishing collective bargaining agreements, personal service agreements, and right assignments;
- Rights acquisitions and use agreements;
- Representation agreements with agents, managers and attorneys.
- Prerequisite: One of the following courses - Entertainment Law, Intellectual Property Survey, Copyright Law, Trademark and Unfair Competition Law

The American Bar Association accreditation standards require students to regularly attend the courses in which they are registered. Lewis & Clark expects students to attend classes regularly and to prepare for classes conscientiously. Specific attendance requirements may vary from course to course. Any attendance guidelines for a given class must be provided to students in a syllabus or other written document at the start of the semester. Sanctions (e.g., required withdrawal from the course, grade adjustment, and/or a failing grade) will be imposed for poor attendance.
