• Description:

  The class will focus upon the unique characteristics of contracts used in the various categories of entertainment. The objective of all entertainment is to expand its audience and to maintain the maximum number of opportunities for future exploitation of the creative content. The class will explore:

  • The types and forms of entertainment agreements;
  • Norms established by entertainment custom and practice;
  • The impact of collective bargaining agreements by unions and guilds;
  • Contract limitations imposed by limits on enforceability by state statutes;
  • • Minimum annual compensation;
    • Restrictions on enforcement of personal service agreements;
    • Negative covenants and injunctions;
    • Judicial approval of minors’ agreements;
  • Distinguishing collective bargaining agreements, personal service agreements, and right assignments;
  • Rights acquisitions and use agreements;
  • Representation agreements with agents, managers and attorneys.

   

  The class will analyze several long-form agreements and draft both key provisions of personal service agreements and a written long-form performance agreement.
