- Description: This course will focus on the creation, protection, enforcement, and fair use of trademarks. We will examine the protections afforded under the Federal Lanham Act, state laws, and international treaties for trademarks, including trade dress. The course will cover options for enforcement through litigation, oppositions before the Trademark Trial and Appeal Board, negotiation, and online social media platform takedowns. We will discuss related issues of false advertising and cybersquatting, and defenses to claims of infringement. The course will look at recent cases, and examples of coexisting and infringement trademarks, with discussion of strategies for trademark protection and counseling clients on developing and managing a trademark portfolio. .
