  • Description: This is an elective course designed to introduce students to the theory and practice of mediation in family law cases, with a special emphasis on communication skills and how to have difficult conversations with parties. These communication skills are transferrable to all areas of legal practice and will make students more prepared for future client and professional interactions. Exploring mediation communication skills will enable students to have more fulfilling relationships in both professional and personal areas of their lives. We will explore theories of family dynamics and family conflict, and of the resolution of such conflict. Students will learn how to mediate difficult parenting plan and custody disputes. Students will learn practical skills and knowledge to intervene with and assist families as both a mediator and an attorney assisting clients in family law mediation. This course will consider ethical issues that arise in the context of family mediation and mediation in general. The course will conclude with a discussion on how to include mediation as an option for parties in private practice and in a firm setting.
