Description: This course provides a working understanding of the core issues and strategies involved in prosecuting a patent before the U.S. Patent & Trademark Office (PTO). We examine such topics as (a) understanding patent claims and their supporting disclosure; (b) responding to common PTO rejections of patent applications; (c) appealing adverse patent examiner decisions; and (d) some advanced topics, such as the prosecuting lawyer’s duty of candor before the PTO, examiner interviews, and petitions.
PLEASE NOTE: This course is not intended as an equivalent to, or substitute for, a commercial patent bar preparation course.

- Evaluation Method: Evaluation will principally be by a series of drafting assignments, oral presentations, and in-class quizzes.

The American Bar Association accreditation standards require students to regularly attend the courses in which they are registered. Lewis & Clark expects students to attend classes regularly and to prepare for classes conscientiously. Specific attendance requirements may vary from course to course. Sanctions (e.g., required withdrawal from the course, grade adjustment, and/or a failing grade) will be imposed for poor attendance.
