- Description: An increasing number of lawsuits turn on technology or technology-related issues. A prime example is patent litigation, which can become an existential crisis in the life of any enterprise. This course will focus on issues common to any technology lawsuit: presenting tech evidence in an understandable and compelling way to judges and jurors, managing and examining expert witnesses, and handling e-discovery and protective orders. Approximately 75% of the course will focus on patent litigation. We will explore the phases of a patent case, with special emphasis on Markman and Summary Judgment hearings as well as related proceedings in the Patent Trial and Appeal Board (PTAB). Students will learn strategic thinking, advocacy and communication. Case studies based on actual lawsuits and courtroom encounters will be explored throughout the class.
- Prerequisite: Civil Procedure. Patent Law and Policy is recommended but not required.

The American Bar Association accreditation standards require students to regularly attend the courses in which they are registered.
