• Description: Oregon has been a leader in a “first things first” approach to constitutional issues, placing primary focus on the state constitution, and creating an adequate and independent state constitutional resolution to most issues. The result is that Oregon constitutional law has developed in significantly different ways than federal constitutional law. For those students looking to practice in Oregon, an understanding of Oregon’s unique constitutional jurisprudence is essential. In this court we will learn how to litigate state constitutional issues in Oregon Courts, and survey the ways in which certain constitutional questions differ in Oregon, specifically free speech, search and seizure, criminal custody, civil remedies, the contracts clause, and others.
