- Description: Oregon has been a leader in a “first things first” approach to constitutional issues, placing primary focus on the state constitution, and creating an adequate and independent state constitutional resolution to most issues. The result is that Oregon constitutional law has developed in significantly different ways than federal constitutional law. For those students looking to practice in Oregon, an understanding of Oregon’s unique constitutional jurisprudence is essential. In this court we will learn how to litigate state constitutional issues in Oregon Courts, and survey the ways in which certain constitutional questions differ in Oregon, specifically free speech, search and seizure, criminal custody, civil remedies, the contracts clause, and others.

The American Bar Association accreditation standards require students to regularly attend the courses in which they are registered. Lewis & Clark expects students to attend classes regularly and to prepare for classes conscientiously. Specific attendance requirements may vary from course to course. Any attendance guidelines for a given class must be provided to students in a syllabus or other written document at the start of the semester. Sanctions (e.g., required withdrawal from the course, grade adjustment, and/or a failing grade) will be imposed for poor attendance.
