• Description:  This course studies the practice of land use law in Oregon. There are two segments to the course. First, we look at the history of, and current events and trends in urban and rural planning at the state, regional, and local levels. Second, we look at the administrative law of handling land use matters before local governments and preparing, briefing, and arguing appeals of land use decisions before the Land Use Board of Appeals and the Court of Appeals.

Students are expected to participate in all class discussions and complete two writing assignments. The combination of these writing assignments may fulfill the WIE writing requirement depending on the quality of the writing products and with the permission of the professor. Each student will also make a brief presentation on a land use topic of their choice, linking that topic with Oregon planning to illustrate the varied practice of planning throughout the state.

The principal readings for the class are in an electronic casebook. Additional readings posted on TWEN supplement the casebook. This is a highly interactive course. Grading will be based on the writing assignments and participation in class discussion.

• Prerequisite: There are no prerequisites, however, course work in administrative law, environmental law, land use, or municipal governments is recommended.
