Description: This course provides an introductory investigation of Anglo-American legal rules governing acquisition, ownership, transfer, and use of real and personal property. We examine acquisition of property through the law of finders, the rule of capture, and the doctrine of adverse possession. We consider ownership and transfer of property by studying estates in land, concurrent ownership, and future interests. We investigate use rights through landlord/tenant law, nuisance rules, and public and private land use controls. The course emphasizes the tension between public needs and private desires in the allocation, transfer, and development of property rights, and applicable constitutional limitations.

The American Bar Association accreditation standards require students to regularly attend the courses in which they are registered. Lewis & Clark expects students to attend classes regularly and to prepare for classes conscientiously. Specific attendance requirements may vary from course to course. Any attendance guidelines for a given class must be provided to students in a syllabus or other written document at the start of the semester. Sanctions (e.g., required withdrawal from the course, grade adjustment, and/or a failing grade) will be imposed for poor attendance.
